fa از حرمت پزشک تا حریم بیمار؛ سرمایه‌‌ای گران‌‌سنگ به‌نام «اعتماد» حقوق پزشکی Madical law پژوهشي Research <div style="text-align: justify;"><span style="font-size:14px;"><strong><span style="color:black;"><span style="font-family:b lotus;">اعتماد طرفینِ یک رابطه‌ی اجتماعی به یکدیگر، شاه‌کلید تنظیم آن رابطه از منظر اخلاق و حقوق است. اعتماد بیمار به پزشک در یک ‌باز‌ه‌ی زمانی طولانی و فرایند چندجانبه به دست می‌آید. در اولین نصوص قانونی، از پزشک، جلب احترام و اعتماد جامعه نسبت به خود و همکارانش مطالبه و در مرحله‌ی بعد، تعهدات حقوقی پزشک ذیل آن تبیین شده است. اگرچه در اصلاحات بعدی، این تعهدات با تغییراتی باقی ماند، هیچ‌گاه ذیل ارزشی به نام &laquo;احترام و اعتماد&raquo; تکرار نشد. در واقع، به‌جای تکلیف پزشک به رعایت مناسک و تهدید به اعمال ضمانت‌‌اجراهای نقض آن، مقنن ابتدا اهمیت این مفاهیم را بیان کرده، سپس با ذکر جزئیاتی تمثیلی، ضمانت‌اجرای نقض آن‌ را بیان کرده بود که از آن به مجازات انتظامی تعبیر می‌شد. قوانین مربوطه نه‌تنها به تعهدات فنی پزشک در درمان تصریح دارند و پزشک را به رعایت شئون حرفه‌ای فرا‌می‌خوانند، بلکه رعایت‌نکردن این تعهدات را تخلف حرفه‌ای محسوب کرده و حسب‌مورد موجب مسئولیت‌ کیفری، مدنی یا انتظامی می‌دانند. به نظر می‌رسد &laquo;احترام&raquo; و &laquo;اعتماد&raquo; جامعه به پزشکان، سرمایه‌ی گران‌قدرِ اجتماعی آن‌ها از یک‌سو و تضمین‌کننده‌ی اثربخشی درمان، به‌واسطه‌ی مشارکت آگاهانه‌ی بیمار از سوی دیگر است. این مهم، در گرو اهتمام پزشک به رعایت حریم بیمار از یک سو و انجام تعهدات فنی و حرفه‌ای خود از سوی دیگر است. این نوشتار، به این ارتباط ناگسستنی و لزوم تحلیل تعهدات حقوقی، ذیل ارزش‌های برتر اخلاقی تأکید دارد.</span></span></strong></span></div> <div style="text-align: justify;">The mutual trust in a social relationship is essential to adjusting that relationship under ethics and law. The functionality of legal and ethical rules can be trusted to create a good, orderly and just relationship when the parties can trust each other under the protection of such rules. The first legal documents in Iran required the practitioner to obtain the respect and trust of the society in himself and his colleagues, and then made clear his obligation under it. In subsequent reforms, such obligation stood as they were, but the values of &ldquo;trust&rdquo; and &ldquo;respect&rdquo; were not mentioned. It seems that &ldquo;trust&rdquo; and &ldquo;respect&rdquo; of physicians in a society is the good will of these professionals which supports the efficiency of the treatment on one hand, and the conscious cooperation of the patient on the other. This matter is dependent on the physician&rsquo;s effort in respecting the patient&rsquo;s boundary and staying true to the physicians own technical and professional obligations.
