fa مسئولیت کیفری ناشی از رعایت‌نکردن دستورالعمل‌ها و ضوابط بهداشتی در بیماری کووید ۱۹ حقوق پزشکی Madical law مروری Review <div style="text-align: justify;"><span style="font-size:14px;"><span style="color:black;"><span style="font-family:B Yekan;">بیماری نوظهور و فراگیر کووید 19 که از سطح همه‌گیری (اپیدمی) گذر نموده و به سطح جهان‌گیری (پاندمی) رسیده، چالش‌های فراوانی را برای جامعه‌ی جهانی ایجاد کرده است. ویژگی‌های خاص بیماری کووید 19 ازجمله ناشناخته‌بودن و پیچیدگی منشأ این ویروس، وسعت و سرعت بالای انتشار و انتقال آن، جهش‌پذیری فراوان، نبود درمان قطعی برای آن تاکنون ، وجود دوره‌ی کمون و نهفتگی بیماری، بررسی همه‌جانبه و تدوین برنامه‌ای جامع را در تمام ابعاد می‌طلبد تا بتوان برای کنترل و مدیریت آن اقدام کرد. سرعت فراوان انتقال این بیماری و ویروس، با بی‌احتیاطی ناقلان و بیماران به‌صورت تصاعدی افزایش می‌یابد. طولانی‌بودن زمان شیوع این بیماری نیز باعث سهل‌انگاری افراد در رعایت پروتکل‌های بهداشتی شده و موجب بیماری افراد دیگر می‌شود؛ ازاین‌رو، بی‌احتیاطی و سهل‌انگاری برخی افراد، ضمن تحمیل بار حقوقی و اخلاقی در رعایت‌نکردن حقوق جامعه، امنیت و سلامت جسمانی و روانی افراد را نیز تهدید می‌کند. یکی از اهداف تدوین قواعد فقهی و قوانین عرفی، صیانت از جان و سلامت افراد است؛ لذا موضوع این نوشتار، بررسی الزامات و ضمانت اجرای ناظر بر مراقبت و پیشگیری از بیماری کووید 19 و مسئولیت کیفری تحمیلی بر افرادی که پروتکل‌های بهداشتی را رعایت نمی‌کنند، با نگاهی فقهی و حقوقی خواهد بود. بر این اساس افرادی که حداقل‌های بهداشتی را در برابر این ویروس رعایت نمی‌کنند، در صورت ناقل‌بودن دارای مسئولیت هستند و در صورت احراز و اثبات قصور یا تقصیر و انتساب اضرار یا آسیب به ایشان، باید از عهده‌ی جبران خسارت برآیند. افزون‌براین، در صورت آگاهی به ناقل‌بودن، امکان تعزیر ایشان نیز وجود خواهد داشت.</span></span></span></div> <div> <div><div id="_com_1" uage="JavaScript"></div></div> </div> <div><div></div><div></div></div> <div style="text-align: justify;"><span style="font-size:12px;">The emerging and pervasive disease of COVID 19 (coronavirus disease), which has gone from an epidemic to a global pandemic, has created many challenges for the international community. Since this disease has certain characteristics such as the unknown and complexity of its origin, high extent and speed of its spread and transmission, high mutability, lack of definitive treatment so far for it, existence of incubation period and latency of the disease and many other features, it requires a comprehensive study and development of a comprehensive plan in all dimensions to be controlled and managed. Due to the high rate of transmission of this disease and lack of care by carriers and patients, COVID-19 has increased exponentially, and on the other hand, the long duration of the disease has caused people to neglect following health protocols, which itself causes other people to get sick. And while imposing a legal and moral burden in non-compliance with the rights of society, it threatens people&rsquo;s security, physical and mental health. On the other hand, one of the goals of the jurisprudential rules and customary laws is to protect the life and health of individuals. The requirements and guarantees of the supervision of care and prevention against COVID-19 and the responsibility imposed on people who do not comply with health protocols will be the subject of this article. Accordingly, people who do not consider the minimum health standards against this virus have a responsibility if they are carriers, and if negligence or fault and attribution of harm or damage to other people is confirmed, they should be able to compensate the damage while being punished.
