other جنبه‌های فقهی و حقوقی و اخلاقی زیرمیزی از دیدگاه صاحب‌نظران و مراجع عظام تقلید Juridical, Legal, and Ethical Aspects of "Under-the-Table Payments " from the Perspective of Experts and Shia Grand Ayatollahs یازدهمین کنگره اخلاق در سلامت - سخنرانی Health Ethics Congress (11th) - Oral Presentation سخنرانی Oral Presentation <div style="text-align: justify;">زیرمیزی پولی است که پزشک، خارج از تعرفه‌ی مصوب و تعیین‌شده برای ارائه‌ی خدمات پزشکی (معمولاً عمل جراحی) از بیمار مطالبه و دریافت می‌کند. در این مطالعه جنبه‌های اخلاقی و حقوقی و فقهی این پدیده که در بین برخی پزشکان رواج یافته، بررسی شده است. این مطالعه‌ی کیفی، ماحصل مصاحبه‌های نیمه‌ساختارمند با هفده نفر از صاحب‌نظران رشته‌های فقه، حقوق، اخلاق حرفه‌ای، فلسفه‌ی اخلاق، اخلاق پزشکی، اقتصاد سلامت و روان‌شناسی اجتماعی است که با روش تحلیل محتوای مرسوم تحلیل و بررسی شده؛ همچنین، از یازده نفر از مراجع عظام، شامل حضرات آیات خامنه‌ای، نوری همدانی، صافی گلپایگانی، مکارم شیرازی، شبیری زنجانی، موسوی اردبیلی، سیستانی، شاهرودی، علوی گرگانی، جعفر سبحانی و یثربی استفتا شده است. در نتایج به‌دست‌آمده از مصاحبه‌ها با صاحب‌نظران، به دریافت زیرمیزی از جنبه‌هایی مانند درنظرنگرفتن مصالح بیماران و ضرررساندن به آن‌ها، به‌خصوص به بیماران فقیر، خدشه در عنصر اعتماد بین پزشک و بیمار، خلاف قوانین و مصالح جاری کشور بودن، ترویج بی‌قانونی، خلاف تعهدات پزشکی و اخلاقی پزشک بودن، اجبار یا اکراه بیمار در پرداخت زیرمیزی، نبودن دریافت یا پرداخت زیرمیزی تحت لوای عقود شرعی، خدشه وارد شده است. به‌علاوه ذکر شد، پزشکی حرفه‌ای (Profession) است که در آن باید منافع بیماران بر پزشکان اولویت داده شود که در اینجا، این موضوع نقض شده است؛ همچنین، در استفتا از مراجع عظام، اکثر قریب به اتفاق آنان، به‌خصوص مراجعی که دیدگاه حکومتی داشتند، این امر را جایز ندانستند و بعضاً دریافت چنین پولی را حرام دانستند. دریافت زیرمیزی به لحاظ اخلاقی و حقوقی و فقهی محل اشکال جدی و بعضاً حرام است. ممکن است، پرداخت زیرمیزی از جانب بیمار به خاطر اجبار به پرداخت آن، اشکالی نداشته باشد، اما دریافت آن از جانب پزشک حتماً اشکال دارد.</div> <div style="text-align: justify;">"Under-the-table payment" refers to money a physician demands and receives from a patient, in addition to the established and approved medical tariff, typically for medical services such as surgical operations. This study aims to examine the ethical, legal, and juridical aspects of this phenomenon, which has become common among many physicians. This qualitative study is based on semi-structured interviews with 17 experts from various fields, including Islamic jurisprudence, law, professional ethics, philosophy of ethics, medical ethics, health economics, and social psychology. The interviews were analyzed using the conventional content analysis method. Additionally, the opinions (fatwas) of 11 Shia Grand Ayatollahs on under-the-table payments were obtained by posing a specific question to them. The findings from the expert interviews revealed several concerns regarding under-the-table payments, including: · Disregard for patients' best interests, particularly causing harm to poor patients; · Undermining trust between doctors and patients; · Violations of national laws and public policies; · Promotion of lawlessness; · Breaches of medical and ethical obligations by physicians; · Coercion or undue pressure on patients to pay such fees. Experts emphasized that medicine is a profession in which patients' interests should take precedence over those of doctors, and in this practice, this fundamental principle is violated. Furthermore, in the fatwas issued by the majority of Shia Grand Ayatollahs - particularly those with governmental perspectives - nearly all deemed this practice impermissible, with some explicitly declaring it forbidden (haram). Receiving under-the-table payments is ethically, legally, and juridically problematic, and in some cases, is considered impermissible, particularly for the physicians involved.
