fa بررسی جنبه‌های اخلاقی و حقوقی اجرای پرونده الکترونیک سلامت در ایران آموزش اخلاق پزشکی Ethics in Medical Education پژوهشي Research <div style="text-align: justify;"><span style="font-size:14px;"><span style="font-family:yekanYW;"><span dir="RTL" lang="FA"><span style="color:black">هدف از این پژوهش، شناسایی مسائل و مشکلات حقوقی اجرای پرونده‌ی الکترونیکی سلامت، اولویت‌بندی، ارائه‌ی کاربست عملیاتی برای ذی‌نفعان، بیان ملاحظات اخلاقی و قانونی در ارائه‌ی این دسترسی‌ها، نحوه‌‌ی بهره‌برداری از این اطلاعات در ابعاد شخصی، حاکمیتی، پژوهشی و قانونی بوده است. اجرای این طرح، به‌صورت خلاصه در مراحل زیر انجام گرفته است:</span></span> <span dir="RTL" lang="FA"><span style="color:black">بررسی متون، مشخص‌کردن جنبه‌های اخلاقی و حقوقی اجرای پرونده‌ی الکترونیک سلامت، بررسی قوانین و مقررات موجود در کشور، مشخص‌کردن نقصان‌های موجود در ایران و بومی‌سازی جنبه</span></span><span style="color:black">‌</span><span dir="RTL" lang="FA"><span style="color:black">های اخلاقی و حقوقی اجرای پرونده‌ی الکترونیک سلامت در ایران و ارائه‌ی پیشنهادهای عملیاتی. با بررسی متون، فهرستی از جنبه‌های اخلاقی پرونده‌ی الکترونیک سلامت، استخراج و بررسی شد؛ همچنین، با مرور قوانین و مقررات به نظر می‌رسد، در دهه‌ی اخیر قوانینی متعدد و متنوع در موضوع سلامت الکترونیک و به‌طور ویژه در موضوع پرونده‌ی الکترونیک سلامت تصویب شده است و خلأ قانونی جدی در این حوزه، در کشور وجود ندارد؛ اما اشکالات جدی زیر در آن به چشم می‌خورد: اجرانشدن یا اجرای ناقص برخی قوانین و مقررات موجود، نبود مقررات فنی و اجرایی کافی و تعیین مصادیق انحراف از اهداف قوانین و مقررات یا اجرای صحیح آن و نبود ضمانت اجرا برای بعضی از قوانین و مقررات. بر اساس اسناد مطالعه‌شده، وضعیت موجود پرونده‌ی الکترونیکی سلامت در کشور، از جنبه‌های حقوقی و اخلاقی بررسی و پیشنهادهای عملیاتی برای اصلاح و ارتقاء آن، ارائه شده است.</span></span></span></span></div> <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:14px;"><span style="font-family:Tahoma;"><span style="color:black">In summary, this project was carried out in the following steps: reviewing the literature, determining the ethical and legal aspects of the implementation of the electronic health records, reviewing the existing laws and regulations in Iran, identifying the shortcomings and localizing the ethical and legal aspects of implementing electronic health records in Iran, and providing operational suggestions. By reviewing the literature, a list of ethical aspects of electronic health records was extracted and analyzed. Moreover, through reviewing the laws and regulations, it was shown that in the last decade, numerous and diverse laws have been passed in the field of electronic health, especially regarding electronic health records, and there is no serious legal gap in this field in the country. However, certain serious problems were observed including non-implementation or incomplete implementation of some existing laws and regulations, lack of sufficient technical and executive regulations and determining the examples of deviation from the goals of the laws and regulations or their correct implementation, and lack of implementation guarantee for some laws and regulations.
