fa پزشکی تدافعی؛ تهدید جدی برای نظام ارائه خدمات سلامت ایران اخلاق بالینی Medical Ethics دیدگاه commentary <div style="text-align: justify;"><span style="font-size:14px;"><span style="font-family:yekanYW;"><span style="line-height:2;">&nbsp;<span dir="RTL" lang="AR-SA"><span style="color:black">پزشکی تدافعی، مجموعه‌ی اقداماتی است که پزشکان و سایرحرفه‌مندان پزشکی با انگیزه‌ی دفاع از خود در برابر تهدیدها و خطرات احتمالی پیشِ رو، به‌ویژه جلوگیری از شکایت بیمار یا محکوم‌شدن در محاکم قضایی، به اشکالِ مختلف، ازجمله پزشکی تدافعی مثبت و منفی انجام می‌دهند. با توجه به اینکه پیشگیری از شکایت و رسیدگی حقوقی، مهم‌ترین انگیزه‌ی انجام‌دادن چنین اقداماتی است که از لحاظ اخلاقی اغلب ناموجه تلقی می‌شوند، صدور احکام قضایی علیه پزشکان می‌تواند این رفتارها را تشدید کند. با توجه به گزارش‌هایی از صدور احکام کیفری علیه برخی پزشکان در ایران و واکنش برخی انجمن‌های حرفه‌ای به این موضوع، مقاله‌ی حاضر با اشاره به مستندات و داده‌های موجود درباره‌ی شیوع گسترده‌ی پزشکی تدافعی در ایران، به بررسی آثار صدور چنین احکامی بر نظام سلامت و ارائه‌ی برخی پیشنهادها برای مدیریت موضوع پرداخته است. هدف از نوشتن این مقاله، تأکید بر اهمیت توجه به انگیزه‌های تدافعی پزشکان در ارائه‌ی خدمات سلامت و عوامل اثرگذار بر آن، به‌ویژه ترس از محکومیت‌های کیفری است که می‌تواند موجب افزایش این رفتارهای تدافعی در بین پزشکان و تشدید تأثیرات منفی ناشی از آن‌ها</span></span><span dir="RTL" lang="FA"><span style="color:black"> بر نظام ارائه‌ی خدمات سلامت</span></span> <span dir="RTL" lang="AR-SA"><span style="color:black">شود.</span></span></span></span></span></div> <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:14px;"><span style="font-family:Arial;"><span style="color:black">Defensive medicine refers to actions taken by doctors and other medical professionals to protect themselves against potential threats and risks, particularly to prevent patient complaints or convictions in court, which is carried out in various forms including positive and negative defensive medicine. Since the primary motivation behind such actions, often viewed as morally unjustified, is to avoid legal proceedings and lawsuits, court rulings against doctors can intensify these behaviors. Reports of criminal sentences against some doctors in Iran and reactions from professional associations highlight the significance of this issue. This study examined the effects of such sentences on the healthcare system by referring to available documents and data on the widespread prevalence of defensive medicine in Iran, offering some suggestions for managing the issue.
