fa بررسی تحلیلی برائت پزشکان از منظر قوانین جاری ایران مدیریت خدمات بهداشتی درمانی Hospital Managment پژوهشی اصيل Original Research <div style="text-align: justify;"><span style="font-family:tahoma;"><strong><span style="font-size:12.0pt;">زمینه و هدف:</span></strong><span style="font-size:12.0pt;"> پزشکی، حرفه&shy;‌ای مقدس است که به دلیل ارتباط مستقیم با جان انسان&shy;ها از اهمیتی والا برخوردار می‌&shy;باشد که از صدر اسلام در سیره‌&shy;ی امامان معصوم(ع) مورد توجه قرار داشته و روایاتی در نکوداشت آن بیان شده است. بررسی روابط میان بیمار و پزشک و آشنایی بیماران به حقوق خود، با پیشرفت روزافزون تکنولوژی و ارتقای سطح آگاهی مردم گسترش یافته است، لکن آنچه بیش از پیش مورد توجه قانونگذار قرار گرفته، جبران خسارات ناشی از اعمال پزشکی است؛ به نحوی‌که عدم رعایت موازین فنی و مقررات پزشکی، ذمه پزشک را در قبال بیمار مشغول کرده و علاوه بر ضمان شرعی، مسئولیت اجتماعی و صنفی نیز بر پزشک حمل خواهد شد.</span><br> <strong><span style="font-size:12.0pt;">روش&shy; بررسی:</span></strong><span style="font-size:12.0pt;"> ابتدا با استفاده از منابع کتابخانه&shy;‌ای و مقالات&shy; معتبر پژوهشی، به شیوه مقایسه&shy;‌ای انجام و سپس با روش توصیفی و تحلیلی مستنداتِ گردآوری شده بررسی گردید. بدیهی است علاوه بر کتاب&shy;ها، مقاله&shy;‌ها و نوشتارهای سایت‌&shy;های فقهی و حقوقی، پژوهشگر از نظرات فقها، حقوق&shy;دانان، پزشکان و زیان&shy;دیدگان امور پزشکی در راستای تبیین هدف پژوهش بهره‌&shy;مند شده است.</span><br> <strong><span style="font-size:12.0pt;">یافته&shy;‌ها:</span></strong><span style="font-size:12.0pt;"> قانونگذار با رعایت ضوابطی، موجبات ضمان و مسئولیت را از پزشک برطرف نموده، که اخذ اذن و برائت از بیمار یا اولیای قانونی وی قبل از اعمال درمانی، از آن جمله است. </span><br> <strong><span style="font-size:12.0pt;">نتیجه‌&shy;گیری: </span></strong><span style="font-size:12.0pt;">در این مقاله، حمایت همه&shy;‌جانبه از اقدامات پزشک در معالجه‌&shy;ی بیماران، مدنظر است. از طرفی، خاطرنشان ساختنِ مسئولیت&shy;های تیم پزشکی در صورت عدم رعایت مقررات پزشکی و همچنین موازین فنی و مقررات صنفی است که مسامحه در این خصوص، عواقب حقوقی به&shy;‌دنبال خواهد داشت.</span></span></div> <div style="text-align: justify;"><span style="font-family:times new roman;"><strong>Background and Aim: </strong>Because of its direct connection with human life, medicine is a sacred profession that has been considered by infallible imams (pbuh) and stories have been told about it from the beginning of Islam. With the increasing progress of technology, the study of the relationship between a patient and his/her doctor and of patients&#39; familiarity with their rights has expanded. However, what has been the focus of legislators&#39; attention more than ever is the compensation of damages caused by medical acts<strong>.<span dir="RTL"></span></strong><br> <strong>Materials and Methods: </strong>First, using&nbsp;library&nbsp;resources&nbsp;and&nbsp;validated&nbsp;research articles,&nbsp;we&nbsp;conducted&nbsp;a comparison&nbsp;method. Then, the collected&nbsp;documents were studied with descriptive&nbsp;and&nbsp;analytical method. In&nbsp;addition&nbsp;to&nbsp;books,&nbsp;articles,&nbsp;and the writings of law and jurisprudence&nbsp;sites,&nbsp;the researcher benefited from&nbsp;the&nbsp;opinions&nbsp;of jurists,&nbsp;lawyers,&nbsp;physicians, and&nbsp;the&nbsp;losers&nbsp;of&nbsp;medical&nbsp;affairs to&nbsp;explain&nbsp;the purpose&nbsp;of this research.<br> <strong>Results: </strong>With certain rules, the legislator has removed the causes of physician&#39;s commitment and responsibility; obtaining the consent of the patient or his/her guardian before treatment is among them.<br> <strong>Conclusion: </strong>This article considers full support for the physicians&#39; acts in curing patients.
