Abstract

Traditional and complementary medicine centers, as providers of health services, have a special responsibility towards patients and clients. With increase in the number of these centers, the role of traditional and complementary medicine has become more important in the analysis, diagnosis, and treatment of illnesses. The accurate and fast performance of medical approaches using evidence-based diagnostic and therapeutic procedures, with consideration of the rights, integrity, and dignity of clients are among the priorities and necessities that can have a significant impact on the satisfaction and acceptance of the scientific and legal institutions, parallel to the deployment of new services provision systems. Lack of sufficient scientific evidence of efficiency and effectiveness, lack of definition and determination of authorities to handle complaints, the legal process of ethical and legal aspects of medical errors has caused challenges for the field of complementary and alternative medicine. Thus, this legal void must be filled through formulation and revision of laws and regulations, defining of the practical and acceptable set of scientific resources, and determination of authorized service centers to resolve complaints and to punish. It is hoped that the results of this review study increase the information of the professionals in this field and attract the attention of authorities of medical ethics to this field.

Abstract

Several definitions for medical futility has been proposed in the literature. Medical futility is defined as the condition in which an intervention, either for diagnosis, prevention, treatment, rehabilitation or other medical goals, has no benefit for the individual patient. This critical review aimed to increase the understanding of physicians and other healthcare providers on the issue of futility in complementary and alternative medicine (CAM). Our comprehensive search resulted in more than 1000 studies; unrelated studies were excluded by title and abstract screening, then 219 full-texts were read and finally, 118 studies were included. The conclusion concerning whether or not it is morally acceptable to provide a futile treatment in CAM, becomes a controversial issue based on different approaches. Using futile treatments is not acceptable according to the duty-based approach, and the principle of justice. In contrast, the case-based approach  and the principle of autonomy of the patient, hold that such treatments could be morally acceptable. Based on utilitarianism, only evidence-based treatments can be morally discussed, and those CAM therapies that have been shown to be futile, should be prohibited; thus health care providers must not offer them to patients since it would be a kind of deceit. We suggest that more comprehensive studies should be performed to clarify the boundary between placebo, nocebo, and futility.

Abstract

Medicalization, in the sense of expansion of medicine in different aspects of human life and ultimately the transformation of medicine into a tool of social control and domination, is a common interpenetration in the literature. This concept, since its inception in the mid-twentieth century, has been an exclusive critique of modern medicine, meaning that branch of medicine based on biomedical paradigm. In this article, we argue that the conceptual shortcoming of this view and the reduction of medicalization to only one medical paradigm, lead to appear medicalization in the new outfit in the name of demedicalization and with more harmful aspects. By focusing on biomedical paradigm or biomedicalization, we neglected other types of medicalization like paramedicalization or CAMization, meaning expansion of Complementary and Alternative Medicine in different aspects of human life. This negligence makes the space to misuse of medicalization for more medicalizing issues. In the following, Iranian Traditional Medicine has been examined as one of the examples of CAM. By presenting historical examples, in the contrast of common understanding of many medical sociologists, we showed that medicalization is not an exclusive concept around modern medicine and its root go back hundreds of year, not just the last hundred year and not only in the western world.
